This paper looks at the issue following the recent limitations imposed on the use of trusts to minimise tax through the Commissioner’s pronouncements on the application of s100A and what constitutes financial accommodation for Division 7A purposes.

It also considers this issue from an international perspective for trusts that have overseas beneficiaries. Finally, the paper considers the utility of trusts for asset protection purposes following developments in case law on this issue.
