This seminar addressed some of the grittier trust problems likely to be encountered by practitioners. The Courts have been particularly active of late in casting new light on old trust law issues. These important cases (including some significant English decisions) are reviewed.

Tax and succession planning with trust replication has attracted huge attention at recent tax seminars. One of Australia's foremost experts on taxation and trusts addresses the difficult stamp duty and asset protection aspects.

The fine tuning of trust interests can be critical in many trust taxation events. The trust law concepts of 'absolute entitlement' and 'vested and indefeasible' are adopted in the tax legislation. The practical implications of these issues are also explored.
