The program

This session examines the residency rules in Australia that apply to individuals, companies and trusts. The session focuses on the Commissioner’s view in TR 2023/1 – Income Tax: residency tests for individuals.  The issue of dual-residence and tax treaties is also covered.

Division 7A is an area of the tax legislation which can become increasingly complex where loans have built up over a number of years. In addition to the complexities, the Division 7A benchmark interest rate is set to almost double for the 2023-24 financial year, and as tax advisors, we are going to need to more closely consider the financial impact of Division 7A loan agreements on our clients. During this session, Kristina will discuss:

  • The financial impact of Division 7A loan agreements including cash flow issues
  • Various situations where deemed unfranked dividends may arise
  • Consequences of not meeting minimum yearly repayments
  • The importance of keeping appropriate detailed records in relation to loans; and
  • The consequences of not having detailed records and what to do if you inherit a client who does not have sufficient records

This session will equip you with the knowledge to more deeply consider the financial impact of Division 7A on your clients, especially those issues that may be messy or out of the ordinary.
