Understand commercial law in relation to property
Australian property law relates not just to tangible property, such as land, but intangibles such as intellectual property. Clients value advice on the type of property that can be dealt with in commercial transactions, including real property, personal property and intellectual property. Aspects of state based laws are also important to understand.
CommLaw3 looks at issues such as the impact of competition and consumer law, the law regulating financing transactions, and laws relating to electronic commerce to help you develop a sound understanding and provide appropriate advice to your clients.
This subject is offered via distance learning using an online learning platform supported by pre–recorded webinars and email support from the Convenor, a subject matter expert.

ATL006 CommLaw3 Property Law is designed to develop your understanding of the fundamental law underlying property transactions and delve into the characterisation of a property transaction as well as the differences in state and territory stamp duty laws, to investigate the true character of a property transaction.

To enrol in CommLaw3, you’ll need to meet English language requirements if your 6 years of high school learning were not conducted in English
Learning outcomes
On completion of ATL006 CommLaw3 Property Law you will be able to, but not limited to, advice on the law regulating financing of Australian commercial transactions and develop and present skilled understanding of the impact of competition and consumer law.

Assessment structure
Please note that all assessment tasks must be passed in order to complete the subject.
Distance learning - a flexible learning approach using an online learning platform supported by pre-recorded webinars and email support with a subject matter expert.
Assessment-only study - allows candidates to accelerate their studies by progressing directly to the assessments for the subject based on prior study, qualifications and experience.
Candidates will only recieve access to past exam papers and online checkpoint tests prior to the exam.

Recognition of prior learning (RPL)
RPL is a process for providing candidates credit for learning or qualifications completed before your enrolment with The Tax Institute Higher Education.
To apply for RPL (fee $200), please complete the RPL form. Evidence of your qualifications will need to be provided with this application.

ATL006 Commlaw3 Property Law
Standard ATL subject enrolment fee $1,995.
Standard ATL subject enrolment fee is GST exempt.
Standard prices are valid until 11 August 2025.
All Tax Institute Higher Education candidates are eligible to receive Education Membership of The Tax Institute for $220 (saving $365) upon enrolment until 30 June in the subsequent calendar year. Member fees attract GST and price quoted is inclusive of GST.
